Deposit Limits Under Kuwaiti Law

  1. Unpaid Utilities (MEW bills): If the lease agreement stipulates that the tenant is responsible for Ministry of Electricity and Water (MEW) fees, and the tenant vacates leaving outstanding balances.
  2. Rent Arrears: Any unpaid rent for the final month(s) or late days prior to the main handover.
  3. Property Damage: The cost to repair significant damages caused by the tenant that exceed standard "normal wear and tear." This includes broken doors, damaged sanitary fixtures, or shattered glass.

Since the law does not strictly mandate a specific timeframe (such as 21 or 30 days), the deadline for returning the deposit is determined by the signed lease agreement.

Typically, landlords return the remaining balance within 7 to 14 days after the tenant has handed over the keys, vacated the premises, and provided a clearance certificate (bراءة ذمة) from the Ministry of Electricity and Water, ensuring the apartment is free of major damages and debts.
