1. Security Deposits

  1. Breach Notice: Provide 20 business days to remedy (CPA requirement).
  2. Court Application: If the breach persists, apply for an eviction order under the PIE Act.
  3. Sheriff Enforcement: Only the Court Sheriff can physically remove a tenant.

4. Maintenance and Habitability

Landlords are responsible for structural soundness, weatherproofing, and ensuring functional plumbing/electrical systems. Tenants are responsible for maintaining the property in the same state as received, excluding fair wear and tear.

5. Dispute Resolution: RHT

The Rental Housing Tribunal provides free mediation and arbitration. Its rulings have the same weight as a Magistrate's Court order. As of 2026, many provinces allow for online case filing and digital hearings.
