The security deposit, known in Spain as the fianza, is a mandatory payment that protects the landlord against property damage or unpaid rent. In Cantabria, the management of this deposit is strictly regulated by the Ley de Arrendamientos Urbanos (LAU) and regional administrative laws. Failure to comply with registration requirements can lead to severe financial penalties and the loss of certain tax benefits for the landlord.

Statutory Deposit Amounts

Return of the Security Deposit

Upon the termination of the lease and the return of the keys, the landlord has a period of one month to return the deposit to the tenant, provided there are no damages beyond normal wear and tear or outstanding utility bills. If the landlord fails to return the deposit within this timeframe, it will begin to accrue interest at the legal rate.

  • Deductions: The landlord must justify any deductions from the deposit with invoices or receipts for repairs or unpaid expenses.
  • Mediation: If the parties disagree on the amount to be returned, the dispute may be resolved in the Juzgado de Primera Instancia.
