While commercial parties enjoy significant freedom of contract, both national and regional (Cantabrian) laws mandate specific disclosures to ensure the transparency of the transaction and the safety of the premises for its intended use.
National Disclosure Requirements
Under Spanish law, specifically the Ley de Arrendamientos Urbanos (LAU) and the Civil Code, a landlord must disclose any "hidden defects" (vicios ocultos) that would make the premises unfit for its commercial purpose.
Energy Performance Certificate (EPC/CEE)
Since 2013, it has been mandatory for landlords to provide an Energy Performance Certificate (Certificado de Eficiencia Energética) to any prospective tenant.
- Validity: Typically valid for 10 years.
- Exemptions: Very small buildings (under 50 sqm) or certain temporary structures.
