The security deposit, known in Spain as the fianza, is a mandatory payment that protects the landlord against property damage or unpaid rent. In Cantabria, the management of this deposit is strictly regulated by the Ley de Arrendamientos Urbanos (LAU) and regional administrative laws. Failure to comply with registration requirements can lead to severe financial penalties and the loss of certain tax benefits for the landlord.
Statutory Deposit Amounts
According to Article 36 of the LAU, the mandatory security deposit for residential leases is equivalent to one month's rent. If the landlord fails to return the deposit within this timeframe, it will begin to accrue interest at the legal rate.
