Under § 535 BGB, Hamburg landlords carry a broad duty to deliver the property in a condition fit for the agreed use and to maintain that condition throughout the entire lease. Unlike in many other jurisdictions, the obligation to repair is not optional — it cannot be fully waived by contractual clause. Core Maintenance Responsibilities
Hamburg landlords are responsible for all structural and installation upkeep, including:
- Roof, exterior walls, and foundations — weather-tightness
