Security Deposits The security deposit (Kaution) may not exceed three months' net cold rent (rent excluding utilities and operating costs)

Ordinary Termination (Ordentliche Kündigung)

Maintenance and Habitability According to BGB § 535 (1), the landlord is obliged to maintain the rental property in a condition suitable for the contractually agreed use

This includes:

  • Functional heating and hot water.
  • Weatherproof windows and doors.
  • Intact sanitary facilities and electrical wiring.
  • Safe drinking water and proper sewage disposal.
  • Freedom from mold (if structurally caused).
  • Minor repairs can be shifted to the tenant via a valid small repairs clause (typically €100–120 per item).
