2. The 20-Day Grace Period and Direct Enforcement

The firmest solution in Kuwait for a commercial tenant who defaults on an agreed payment date is to grant the 20-day legal grace period, and present the rent cheque at precisely its due date to record the 'bounced' status from the bank. If the twenty days pass without payment of the due amount, landlords now have enhanced enforcement options. With the recent regulations, overdue rent can be collected more directly through notarized lease contracts, potentially streamlining the process and reducing the immediate need for a full eviction lawsuit. This new mechanism offers a faster path to recovering arrears. However, if direct collection fails, the landlord retains the right to file an immediate eviction lawsuit before the Rental Court. Here lies a required point: withdrawing from business operations due to an eviction judgment creates extreme pressure on the commercial tenant to promptly pay the arrears before facing a full shutdown.

3. Drawing from the Bank Guarantee

If the landlord holds a Bank Guarantee, they can, upon any delay, issue a formal warning outlining the breach and then withdraw the equivalent of the delayed rent directly from the bank without resorting to prolonged litigation, which saves immense time and effort.
