For a residential lease to be legally valid in Malta, it must adhere to the strict requirements set out in the Private Residential Leases Act.
Mandatory Written Contract
All leases must be in writing. A valid Maltese lease agreement must include:
- Description of the property.
- The agreed use (residential).
- The duration of the lease (start and end dates).
- The rent amount and payment method.
- The security deposit amount.
- A detailed inventory of contents and condition.
Mandatory Online Registration
Landlords are legally obligated to register the lease on rentregistration.mt within 10 days of the lease start date. The registration process requires:
- An account with the Housing Authority.
- A digital copy of the signed lease agreement.
- Payment of a registration fee (currently €10).
Inventory Requirement
The inventory is not just a best practice; it is a legal requirement. It must clearly state the condition of the furniture and appliances. Attaching photographs is highly recommended to prevent future disputes.
Written Contract Formalities
To be legally enforceable, a lease agreement in Malta must be executed in writing. For commercial properties governed by the Civil Code (Cap. 16), the contract must explicitly state the identity of the parties, the specific property being leased, the precise permitted use, and the agreed rent amount. For residential leases governed by the Private Residential Leases Act, the contract must also explicitly include the inventory and be officially registered with the Housing Authority to be valid.
