Establishing a tenancy in New South Wales (NSW) requires strict adherence to standardized documentation. Handshake agreements or heavily customized, non-standard lease templates are highly discouraged and often legally unenforceable.

The Standard Form Agreement

In NSW, it is practically mandatory to use the Standard Form Residential Tenancy Agreement. While landlords can add "additional terms" (often called Special Conditions), they cannot alter the standard core terms protecting the tenant.

The agreement must explicitly state:

  • The names and contact details of both the landlord and tenant.
  • The address of the rental property.
  • The amount of rent and how/when it is to be paid.
  • The term of the lease (usually fixed for 6 or 12 months, then reverting to a periodic agreement).

Landlords must provide the tenant with a copy of the agreement before they sign it to allow them time to read it. Once signed, the landlord must give the tenant a fully executed copy within 14 days.

The Condition Report

A condition report is arguably the most critical defensive document a landlord possesses. It details the exact state of repair and cleanliness of the property.

The Rules:

  1. The landlord or agent must complete their section of the condition report before the tenant moves in.
  2. The landlord must provide the tenant with two paper copies (or an electronic copy) of this completed report before or at the time they give the tenant the keys.
  3. The tenant has 7 days to review the property, add their own comments to the report, and return a copy to the landlord.

Without a meticulously completed condition report, it is incredibly difficult for a landlord to successfully claim a bond deduction for damage at the end of the tenancy via NCAT.

Prohibited Fees and Clauses

NSW law strictly bans certain charges and clauses from being inserted into lease agreements.

Banned Fees

Landlords and agents are prohibited from charging tenants "extra fees" to set up the tenancy. This includes:

  • Fees for drafting or preparing the lease agreement.
  • Fees for background checks, reference checks, or credit checks.
  • Fees for simply applying for the rental property.

Banned Clauses

Any "additional term" added to the standard agreement is instantly void and legally unenforceable if it contradicts the Residential Tenancies Act. Common illegal clauses include:

  • Requiring the tenant to pay for professional carpet cleaning at the end of the lease (unless they have kept a pet).
  • Requiring the tenant to use a specific, nominated cleaner or tradesperson.
  • Requiring the tenant to pay a penalty (or a higher rent amount) if they breach the agreement or pay rent late.
  • Absolving the landlord from their legal responsibility to fix structural issues.

Mandatory Information Checklist
