Mandatory Administrative Requirements
1. Landlord Registration Scheme
All private landlords in Northern Ireland must be registered with the Landlord Registration Scheme before letting a property. Landlords must renew this registration every three years. Failure to register or renew is an offence punishable by fixed penalty notices or court fines.
2. Tenancy Information Notice
Landlords must provide a free Tenancy Information Notice within 28 days of the tenancy starting. This is a prescribed legal document that outlines:
- Rent and rates breakdown.
- Tenancy duration.
- Deposit details and how it is protected.
- Landlord responsibilities.
If any of this information changes during the tenancy, the landlord must issue a Notice of Variation within 28 days of the change.
3. Rent Books and Property Books
Landlords must provide tenants with a rent book (provided free of charge). Additionally, the Private Tenancies Act 2022 requires landlords to provide written receipts for any payment made in cash.
New Health & Safety Deadlines (2024–2025)
Northern Ireland has introduced phased safety requirements that all landlords must meet.
Mandatory Safety Alarms (Effective 2024)
New regulations for smoke, heat, and carbon monoxide alarms took effect for all new tenancies on September 1, 2024, and for all existing tenancies by December 1, 2024. Landlords must install:
- Smoke alarms: In the principal habitable room and every circulation space (hall/landing) on each storey.
- Heat alarms: In every kitchen.
- Carbon Monoxide alarms: In any room with a fixed combustion appliance (gas boiler, open fire, wood burner). All smoke and heat alarms must be interconnected and tamper-proof.
Electrical Safety Standards / EICR (Effective 2025)
The Electrical Safety Standards Regulations (NI) 2024 mandate comprehensive electrical testing.
- Implementation: Applies to all new tenancies from April 1, 2025, and existing tenancies by December 1, 2025.
- Requirement: A qualified electrician must inspect and test the fixed electrical installations at least every 5 years.
- Reporting: The landlord must obtain an Electrical Installation Condition Report (EICR).
- Disclosure: A copy of the EICR must be provided to new tenants before they occupy, to existing tenants within 28 days of the test, and to local councils within 7 days upon request. Any required remedial "C1" or "C2" work must be completed within 28 days.
Additional Certifications
- Gas Safety Certificate: Mandatory annual checks by a Gas Safe registered engineer. A copy must be provided to the tenant.
- Energy Performance Certificate (EPC): Must be provided free of charge to prospective tenants before they rent the property. Currently, NI properties must have an EPC rating of at least E, though higher standards are anticipated.
