Lease Requirements: The 3-Year Term and Written Clauses

To establish that a roof provided for money (rent) in Greece falls under protected "Primary Residences", a handshake is not enough. The Greek State has included strict time shields that Landlords must know when drafting the Private Agreement, even before entering it for declaration on TAXISnet.

1. The "Written" Form (Private Agreement)
Legally, the Greek Civil Code allows even for an oral lease (Article 574 CC). But, in practice, without a written Private Agreement you are lost:
- Tax Obligation: As explained in the Declaration Guide (TAXISnet), without exact document details, electronic acceptance on TAXIS is impossible. Practically, the "Electronic Declaration of AADE" has largely replaced the authority of paper, but the paper (Private Agreement PDF/Word) remains the foundation of judicial proof for special terms (damages, increases, etc.).
2. The Golden Rule: The Mandatory Three-Year Term (3 Years)
Greece has perhaps the most "simple but non-negotiable" rule of minimum lease duration in Europe for Primary Residence Contracts (Law 1703/1987, as applicable).
- The Rule: A primary residence lease is obligatorily valid for at least three (3) years.
- Absolutely Binding (Mandatory Law): If you have a new tenant sign a contract that clearly states "The lease ends in 12 months and then the tenant must leave", the law intervenes and erases the 12 months, converting it into a 3-year term (36 months) in favor of the tenant (provided they wish to stay).
- Exception to the 3-Year Rule? The 3-year period can be broken "before its time" ONLY if the Landlord and Tenant agree in good faith (provably, usually with a notarial act or a new termination agreement) - at least 6 months after the start of the original contract!
3. Categories of Exceptions (Absence of 3-Year Term)
The 3-year rule has holes, but only if the property is not the citizen's "Primary / Permanent Residence":
- Student Housing: Has a special framework. Its duration is usually for the duration of the studies.
- Secondary (Holiday) Home: If someone rents your house in Chalkidiki for the summer months of July-August, this does not fall under the 3-year protection. The lease ends at the end of August exactly as agreed.
- Short-term Lease (Airbnb): If you rent for less than 60 days per client and provide sheets/towels without other services, you sign with the Property Registry Number (AMA), without the slightest 3-Year protection (different legislation).
4. Termination Before the End of the 3-Year Term (Breaking the Contract)
What if the tenant wants to leave at 1.5 years? Legally, they owe rents until the end of the 3 years! Practically: If the tenant gives notice "I'm leaving in a month", most landlords in Greece let them go without going to court, naturally keeping the Security Deposit as a penalty for the premature break. However, formally, the landlord can seek all the lost rents because the three-year term "binds" both.
