The Private Tenancies Act (NI) 2022

This Act phased in several critical protections for tenants:

  1. Capped deposits: Landlords can no longer ask for more than one month's rent as a security deposit.
  2. Extended notice periods: The time a landlord must give a tenant to leave has been proposed to significantly increase, based on how long the tenant has lived there (currently under consultation in January 2026).
  3. Mandatory receipts: Landlords must provide written receipts for any cash payments.

Security Deposits

By law, deposits are capped at one month's rent and must be protected in an approved Tenancy Deposit Scheme within 28 days. The landlord must provide the tenant with prescribed information about the scheme within 35 days.

Eviction Process (Notice to Quit)

Unlike England's Section 8 and Section 21 notices, Northern Ireland relies on the Notice to Quit under the Private Tenancies Act (NI) 2022. Landlords must give written notice depending on the length of the tenancy. A consultation in January 2026 proposed significant extensions to these periods: 8 weeks for tenancies less than 1 year, 4 months for 1-3 years, 6 months for 3-8 years, and 7 months for 8+ years. If the tenant does not leave, the landlord must obtain a court order.

Health, Safety, and Disclosures (2026 Standards)

  • Alarms: Interlinked smoke, heat, and carbon monoxide alarms are mandatory in all private rentals as of December 1, 2024.

Rent Increases As of April
