Commercial property maintenance in Thailand depends primarily on the terms of the lease agreement, particularly whether it is a Gross or NNN (Triple Net) lease.
Responsibility Allocation by Lease Type
Default Legal Position
Under the CCC, if the lease is silent on maintenance:
- Landlord must deliver property suitable for its intended use
- Landlord is responsible for major repairs to maintain property condition
- Tenant is responsible for ordinary maintenance and minor repairs
Building Code Compliance
Commercial properties must comply with the Building Control Act:
- Fire safety systems — Extinguishers, sprinklers, emergency exits
- Electrical systems — Per EIT standards
- Structural integrity — Periodic safety inspections
- Occupancy permits — Must remain valid
Best Practices for Landlords
- Detail maintenance responsibilities in the lease
- Create a preventive maintenance schedule for major systems
- Conduct regular property inspections
- Keep complete maintenance records
