Evicting a tenant in Egypt has historically been a landlord's greatest nightmare, often involving years of dragging court litigation. However, recent legislative amendments-specifically the expansive 2025 "Old Rent" reforms-have explicitly targeted speeding up the judicial process to return property rights to owners.
Eviction Under the "New Rent" System (Fixed-Term)
For modern contracts signed under Law No. 4 of 1996, the lease is a fixed-term agreement (e.g., 1 or 2 years).
1. End of Contract Strategy
Under the Civil Code, when a fixed-term contract reaches its exact end date, the tenancy automatically terminates. The landlord is practically and legally not required to send a complex "notice to quit" months in advance, though issuing a formal warning via a court bailiff (Inthar) 30 days prior is highly recommended as best practice to establish a paper trail that the landlord desires the unit back.
2. At-Fault Eviction (During the Lease)
If the tenant breaches the contract during the term (non-payment of rent, damaging the property, or subletting without permission), the landlord must:
- Send an official legal warning (Inthar) via the court bailiff demanding payment/rectification within a strict timeframe (usually 15 days).
- If the tenant fails to comply, file a lawsuit in the civil courts to terminate the lease.
The Historical Challenge: In the past, defending an at-fault eviction in the general civil courts could take anywhere from 1 to 3 years due to bureaucratic delays and tenant appeals.
The Post-2025 Faster Era: Urgent Courts
To combat these horrific delays, recent government reforms-culminating alongside Laws No. 164 and 165 of 2025-have vastly covereded Urgent Courts (Court for Urgent Matters).
The Fast-Track Mechanism
If a tenant refuses to leave on the exact day their fixed-term contract ends, the landlord no longer has to suffer through years of standard civil litigation.
- The landlord can immediately apply to the Urgent Court.
- The judge can issue an immediate writ of execution for eviction.
- Crucially, the 2025 reforms dictate that even if the tenant attempts to file a separate, frivolous lawsuit claiming the contract is actually longer, this will not suspend the Urgent Court's eviction order. The police will enforce the lock-out rapidly.
The "Notarized Lease" Trick
To ensure access to the fastest possible eviction, savvy Egyptian landlords take their signed lease agreement to the local Notary Public (Shahr Al Akari) on the first day to attach an executive formula (Sighet Tanfeezia) to the contract. If the tenant defaults on rent or overstays the end date of an authenticated contract holding this formula, the landlord can largely bypass the courts altogether and go directly to the execution police to reclaim the property in a matter of weeks.
Evicting "Old Rent" Tenants (The 7-Year Clock)
For decades, removing a pre-1996 "Old Rent" tenant was legally impossible unless the building was collapsing. The 2025 legislative overhaul changes this. Landlords cannot evict them today, but Laws No. 164 and 165 established a strict, permanent countdown:
- Residential Old Rent: Tenants have exactly 7 years (from 2025) before mandatory, absolute eviction forces them to hand the property back to the landlord.
- The government has promised to prepare alternative social housing for vulnerable tenants displaced by this 7-year deadline.
