1. Acceptance of Terms

By accessing or using Landager ("the Service," "we," "us"), a property management Software-as-a-Service (SaaS), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Description of Service

Landager is a software platform designed to assist independent landlords with tracking properties, managing tenants, administering leases, logging maintenance, and tracking financial metrics.

No Professional Advice

Landager provides software tools, not legal, financial, or tax advice. We do not guarantee that your use of the Service is compliant with local rental, eviction, or Fair Housing laws. You are solely responsible for ensuring your property management practices comply with all applicable local, state, and federal laws.

3. Account Registration & Security

To use the Service, you must create an account providing accurate, complete information. You are strictly responsible for maintaining the confidentiality of your account credentials (including OAuth integrations like Google Sign-In) and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. Subscription Plans & Payment Terms

  • Starter Plan (Free): Manage up to 3 units with core tracking features at no cost.
  • Pro Plan ($10/month): Manage up to 15 units with advanced features including AI Chat, advanced reports, and priority support.
  • Premium Plan ($29/month): Manage up to 50 units with all Pro features plus VIP support.

Paid plans are billed monthly through our merchant of record, Lemon Squeezy. Subscriptions automatically renew until canceled. All payments are non-refundable unless required by law. Prices are subject to change with 30 days' prior notice.

5. Landlord Liability & Data Processing (GDPR)

If you operate within the European Economic Area (EEA), the UK, or process data of tenants residing there, you formally agree that you are the Data Controller of the tenant data you input into Landager. Landager acts solely as your Data Processor.

You guarantee that you have a lawful basis (e.g., explicit consent or contractual necessity) to collect your tenants' Personally Identifiable Information (PII) and upload it to Landager. You are responsible for handling direct privacy requests from your tenants.

6. Acceptable Use Policy

You agree not to use Landager to:

  • Manage properties used for unlawful purposes (e.g., illegal short-term rentals, criminal enterprises).
  • Store or distribute malicious software.
  • Engage in discriminatory housing practices prohibited by the Fair Housing Act or similar local equality laws.
  • Attempt to breach, reverse-engineer, or disrupt the Service's infrastructure or security mechanisms.

7. AI Features & Disclaimer of Warranties

Landager integrates artificial intelligence (AI) features powered by third-party APIs (such as Google Gemini). These features are provided "AS IS."

  • Accuracy: AI chat responses are generated by language models and may contain "hallucinations" or inaccuracies. You must independently verify any legal, financial, or property advice generated by the AI before acting on it.
  • General Disclaimer: The entire Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including fitness for a particular purpose or non-infringement.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Landager, its creators, affiliates, or suppliers be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including damages for loss of profits, goodwill, data, or other intangible losses, arising out of or relating to the use of, or inability to use, this Service.

Under no circumstances will Landager be responsible for any financial loss, eviction delays, or legal penalties you incur due to software bugs, downtime, or misinterpretation of dashboard data.

9. Indemnification

You agree to defend, indemnify, and hold harmless Landager from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

  • Your violation of these Terms or any applicable law.
  • Your violation of tenant privacy rights or failure to secure consent for data processing.
  • Any disputes between you and your tenants.

10. Termination

You may terminate your account at any time via the dashboard Settings. We reserve the right to suspend or terminate your account immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction. However, as Landager is owned and operated by an independent creator, any disputes shall be governed by the laws of the jurisdiction in which the creator resides at the time the dispute arises, without regard to its conflict of law provisions.

Binding Arbitration: Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration. YOU AGREE TO WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
