Unlike many neighboring Great Lakes states, Michigan law does not rigidly cap the exact dollar amount a landlord can charge a tenant for failing to pay their rent on time.
However, just because there is no statutory limit does not mean a landlord can charge an exorbitant, punitive late fee. A landlord's late fee policy must adhere to Michigan's common-law doctrines governing generic contracts and "liquidated damages."
No Statutory Late Fee Cap
Michigan does not have a state law dictating that late fees cannot exceed 5% of the rent, nor does it mandate a mandatory 5-day "grace period" before a landlord can legally apply a late fee.
The "Reasonableness" Standard
Because there is no explicit statute, late fees are governed by the Michigan courts' interpretation of contract law. A late fee must be deemed a "reasonable estimate" of the actual administrative and financial loss the landlord suffers due to the late payment (this is legally known as liquidated damages).
A late fee cannot simply be a penalty designed to punish the tenant.
If a tenant's rent is $1,000, and the landlord attempts to charge a $500 late fee on the second day of the month, a Michigan District Court judge will likely refuse to enforce the clause during an eviction hearing, deeming it an unconscionable penalty that bears zero relation to the landlord's actual administrative costs.
Generally accepted "reasonable" late fee structures in Michigan include:
- A flat fee of $30 to $50 applied after a 3-to-5 day grace period.
- A daily fee of $5 per day (often capped at around $50 or $100 per month).
- A percentage-based fee representing 5% of the total monthly rent.
Late Fees Must Be in the Written Lease
A landlord cannot retroactively decide to charge a tenant a $40 late fee if the tenant pays late. The exact trigger date (e.g., "rent is due on the 1st, late on the 4th") and the exact dollar amount must be explicitly detailed in the signed, written lease agreement. If the lease is silent regarding late fees, a landlord cannot enforce them.
Handling Bounced Checks (NSF Fees)
If a tenant pays their rent with a check that bounces due to non-sufficient funds (NSF), Michigan law formally allows landlords to charge a penalty for the dishonored check.
Under MCL 600.2952, a landlord can legally demand:
- The original amount of the bounced check.
- A $25 processing fee (or the actual cost the bank charged the landlord for the bounced check, whichever is greater).
If the tenant refuses to pay the bounced check amount and the required processing fee within 30 days of receiving a formal, written demand, the landlord can potentially sue them for up to 3 times the amount of the check, but not more than $500, plus court costs.
