In Norway, the starting premise is that the initial rent is freely agreed upon. However, after the tenancy has started, the Tenancy Act (Husleieloven) protects the tenant against arbitrary increases. Landlords have two legal methods to raise the rent: Index regulation and adjustment to Current level of rent (Gjengs leie).

Method 1: Index Regulation (Consumer Price Index - CPI)

The most used method is to adjust based on Statistics Norway's (SSB) CPI.

  • Only once a year: Rent can be regulated to CPI maximum once every 12 months.
  • The first time: New rent cannot be implemented until the lease has lasted at least one year.
  • The notice (1 Month): Landlord must send written notice at least one month before the increase takes effect.
  • Calculation: Use SSB's official "Rent Calculator." Rounding up beyond the calculated decimal amount can make the entire claim illegal.

Method 2: Current Level of Rent (Gjengs leie)

Since CPI follows inflation, it may fall behind actual market rates. The "Gjengs leie" safety valve allows adjustment to the average market rate for similar dwellings in the area.

  • The 2.5-year rule: Notice can only be sent after the tenancy has lasted 2.5 years (30 months).
  • Six (6) months' notice: The notice period is six months, meaning the new rent only applies after 3 full years have passed.
  • Conflict: If contested, the case may require an appraisal committee or the Rent Disputes Tribunal (HTU).

Illegal Increases Increases exceeding CPI or "Gjengs" notice periods are breaches of the law (§ 4-1). Tenants can legally refuse to pay any amount exceeding the authorized adjustment.
