Security Deposits

Regulations for rent security deposits (Mietkaution) are determined federally by the BGB. The deposit may not exceed three months' rent (net cold rent, excluding utility prepayments). An extraordinary (immediate) eviction is possible if the tenant is in arrears for two consecutive months' rent or has committed other severe breaches of contract.

Statutory notice periods for landlords depend on the length of the tenancy:

  • Up to 5 years: 3 months

  • More than 8 years: 9 months

Maintenance and Habitability
