A watertight lease is the only line of defense for a landlord in Hungary. Because the Civil Code allows significant freedom of contract, failing to include specific, protective clauses in your lease agreement means you automatically default to the generalized—and often pro-tenant—statutory rules.
The Written Requirement and "Two Witnesses"
The absolute most critical rule in Hungary is that a residential lease must be in writing to be legally binding. An oral agreement leaves the landlord with virtually no enforceable rights.
To make the private written contract fully valid and legally actionable (such as allowing the tenant to register their address at the local government office), the document must be drafted as a Formal Private Document with Full Probative Force (Teljes bizonyító erejű magánokirat).
To achieve this status, the lease must either be:
- Written completely by hand and signed by the parties (rare).
- Typed, signed by the landlord and tenant, and co-signed by two independent witnesses, who provide their names, signatures, and addresses verifying that the parties signed the document in their presence.
- Countersigned by an attorney (ügyvéd).
- Drafted entirely as a Notarial Deed (közjegyzői okirat).
Fixed-Term vs. Indefinite Leases
Hungarian landlords unequivocally prefer Fixed-Term Leases (Határozott idejű bérleti szerződés), usually set for exactly one year.
The Power of the Fixed Term
A fixed-term lease provides massive stability for the landlord. Under Hungarian law:
- Neither the landlord nor the tenant can terminate a fixed-term lease early without an extraordinary, severe justification (e.g., non-payment of rent, or massive destruction of property). If the tenant simply wants to move out after 6 months, they are legally liable for the rent for the remaining 6 months (or they forfeit their deposit as a liquidated damage penalty, if so stipulated).
- When the 12-month period ends, the tenant no longer has any legal right to occupy the premises. The landlord can simply refuse to renew the contract, forcing the tenant to leave without needing to provide a "just cause" for eviction.
The Danger of Indefinite Leases
An indefinite lease (Határozatlan idejű bérleti szerződés) rolls on indefinitely month-to-month. While this sounds flexible, it is incredibly dangerous for the landlord. To terminate an indefinite lease, a landlord must usually provide a lengthy notice period (often 1 to 3 months) and, depending on the framing, may struggle to evict a tenant who decides to stay and fight the termination in court.
Mandatory Clauses and Identification
A valid Hungarian residential lease must clearly and explicitly identify:
- The Contracting Parties: Full legal names, dates of birth, mothers' maiden names (a standard unique Hungarian identifier), ID card numbers, and permanent addresses.
- The Leased Premises: It is not enough to simply state the address. The lease must include the Topographical Lot Number (Helyrajzi szám) matching the exact cadastral registry of the property.
- The Rent and Payment Terms: The exact monthly rent amount (in HUF or EUR), the specific day of the month it is due (e.g., the 5th of every month), and the method of payment (generally bank transfer).
- Utility Apportionment: The lease must explicitly state who pays the common condominium costs (közös költség) and how individual utilities (water, electricity, gas) are billed—whether the tenant puts the meters in their own name or reimburses the landlord monthly based on meter readings.
Subleasing and Pet Restrictions
Subleasing (Albérlet) By default under the Civil Code, a tenant is permitted to sublease the apartment or receive an additional roommate if they obtain the landlord's consent. Therefore, standard professional leases always contain an explicit clause strictly prohibiting any form of subleasing or assigning the lease to a third party (including listing the unit on Airbnb) without the prior, written, discretionary approval of the landlord.
Pet Restrictions Landlords are generally free to prohibit pets in the rental agreement. If a "no pets" clause is included and the tenant smuggles a dog into the apartment, it constitutes a material breach of contract, allowing the landlord to terminate the fixed-term lease immediately or retain the security deposit to cover deep cleaning.
