Historically, Northern Ireland had few restrictions on how often a landlord could increase rent in the private sector. However, the Private Tenancies Act (NI) 2022 introduced strict new controls that remain fully in effect for 2026.

The 12-Month Rule

Under the Private Tenancies Act (NI) 2022, landlords are legally prohibited from increasing the rent:

  1. Within 12 months of the start of a tenancy.
  2. Within 12 months of the previous rent increase.

This essentially limits landlords to one rent increase per year. Any attempt to increase rent more frequently is invalid, and tenants are not legally obligated to pay the increased amount.

Required Notice Period

Landlords must provide tenants with at least eight weeks' written notice before a rent increase can take effect.

Example Timeline:

  • Tenancy starts on June 1, 2025.
  • The earliest the rent can legally be increased is June 1, 2026.
  • The landlord must serve the written notice of the increase no later than April 6, 2026.

Rent Control and Market Rent

Unlike jurisdictions with strict percentage-based rent caps, Northern Ireland generally allows the landlord and tenant to agree on the open market rent. The 2022 legislation regulates the frequency and notice, rather than capping the exact amount of the increase.

Protected and Restricted Tenancies

A small number of historic tenancies (pre-1978) are subject to "registered rents" determined by a Rent Officer. For the vast majority of private tenants in 2026, the 8-week notice and 12-month frequency are the primary controls.

Using a Notice of Variation

A rent increase changes a fundamental term of the tenancy. Under Northern Ireland law, the landlord should issue a Notice of Variation to the tenant's Tenancy Information Notice within 28 days of the new rent taking effect.
