Implied Warranty of Habitability

Safety Equipment

  • Install and maintain smoke detectors in required locations
  • Install and maintain carbon monoxide detectors per state fire code
  • Ensure locks on doors and windows are functional

Waste Management

  • Provide trash receptacles adequate for the property
  • Arrange for regular waste removal

Mandatory Liability Insurance (§34-18-22(a)(7))

  • As of 2024, Rhode Island landlords must maintain a general liability insurance policy of at least $100,000 per occurrence for personal injury and property damage.
  • Proof of insurance should be readily available and may be required for rental registration.

Repair Request Process

Step 1: Tenant Written Notice

The tenant must provide the landlord with written notice of the needed repair, describing the issue in detail.

Step 2: Landlord Response

The landlord must respond and begin repairs within a reasonable time after receiving notice. What constitutes "reasonable" depends on the nature of the problem:

Tenant Remedies for Non-Repair

Repair and Deduct (§34-18-30)

  • After providing a 20-day written notice to the landlord (or less in an emergency), tenants may make the repairs themselves if the landlord fails to act.
  • The cost of the repair cannot exceed $500 or half the periodic rent, whichever is less (limit increased from $125 in 2024).
  • The repair must be for conditions that materially affect health and safety.
  • The tenant must submit an itemized bill for the actual and reasonable cost of the repair when deducting it from the rent.

Rent Withholding

  • If conditions are severe enough to affect habitability, tenants may withhold rent until repairs are made
  • Tenants should document the conditions and typically place withheld rent in an escrow account

Lease Termination (§34-18-28)

  • If conditions are materially noncompliant, the tenant may deliver a written notice stating the lease will terminate in 20 days if the breach is not remedied.
  • However, if the landlord makes a good faith effort to commence repairs and complete them within a reasonable time, the lease will not terminate, even if the work takes longer than 20 days to finish.

Court Action

  • Tenants may file a complaint in court seeking an order to compel repairs
  • Courts may award damages for diminished value of the housing during the period of non-compliance

Rhode Island municipalities enforce building and housing codes through local code enforcement officers. Landlords should be prepared for:

  • Routine inspections — Some municipalities conduct periodic rental property inspections
