Understanding the legal structure governing the rental market is crucial for successful property management in Bahrain. The Kingdom modernized its landlord-tenant relationship with the introduction of Law No. (27) of 2014 with respect to the Leasing of Premises (effective 22 August 2014).

The Foundation of Bahraini Tenancy

The 2014 Lease Law brought clarity, security, and standardization to residential properties:

  • Mandatory Registration: Every lease must be registered with the Lease Registration Office within one month of signing.
  • Rent Increase Caps: Residential rent increases are capped at 5% and cannot be applied until two full years have passed.
  • Security of Tenure: Landlords are prohibited from requesting a residential tenant to vacate for three years from the date of handover, provided the tenant is not in breach.

Registration Process & Importance

Registering your property with the Lease Registration Office at the relevant Municipality (such as Amanat Al Asima) is not optional. Registration fees for residential properties range from BHD 1 to BHD 5. Operating without a registered lease:

  1. Disables your right to use the Rent Disputes Committee.
  2. May result in statutory penalties.
  3. Complicates EWA (Electricity and Water Authority) account transitions.

Rent Increases and Maintenance

Under Article 27, rent cannot be increased until two full years have passed from the lease commencement date or the date of the last increase. Landlords must provide written notice via registered mail at least 3 months before the end of the second year. Rent can only be increased a maximum of 5 times during the entire term of the tenancy.

Regarding maintenance (Articles 9 & 11), the landlord is legally obligated to perform structural and essential repairs to keep the property habitable. If the landlord fails to do so after notice, the tenant may perform the repairs and deduct the cost from the rent.
