Lease Requirements in Cyprus

In Cyprus, residential leases are primarily governed by the Contract Law Cap. 149. A properly drafted and certified tenancy agreement is vital to protect the landlord in the event of a court dispute or eviction proceeding.

1. Written vs. Oral Contracts

While oral contracts can technically be valid under certain, highly restricted scenarios, the Contract Law (Section 77) explicitly mandates that any property lease with a duration exceeding one (1) year is completely invalid unless it is made in writing. Today, all tenancies should be executed solely via written contracts to ensure enforceability.

2. Required Witnesses for Execution

For a tenancy agreement exceeding one (1) year to be legally binding, it must be signed by both parties in the presence of two (2) reliable witnesses, who must also sign the document (Section 77, Cap. 149). Failing to secure witness signatures can render a multi-year lease agreement void.

However, if rent is actively paid and accepted on a void lease, the relationship legally devolves into a monthly periodic tenancy, potentially subjecting the property to Statutory Rent Control earlier than intended.

3. Stamp Duty Requirements

Cyprus tax legislation requires the formal "stamping" of all lease agreements:

  • The contract must be stamped within 30 days of its signing date.
  • The cost depends on the total contract value (i.e., monthly rent x numbers of months). Generally, values up to €5,000 incur no fee. Values between €5,001 and €170,000 incur a rate of 0.15%.
  • Delays in stamping result in penalty fees. Most importantly, an unstamped contract cannot be presented as evidence in a Cyprus Court in the event of a dispute, until the due duty and a substantial penalty are paid directly to the Registrar.

It is customary for the tenant to bear the cost of stamping, but the contract should specify this distribution explicitly.

Essential Lease Clauses

A robust residential tenancy agreement in Cyprus should include clauses detailing:

  • Prohibition of Subleasing: Protects landlords from unauthorized sub-letting or Airbnb hosting without explicit written consent.
  • Permitted Use: Explicitly state that the property is "Permitted strictly for private residential use."
  • Pets: Clearly outline whether pets are permitted and under what specific conditions.
  • Common Expenses (Management Fees): Define who pays for the monthly building communal fees and municipal refuse collection. Typically, the listed base rent does not cover these fees unless otherwise agreed.
