The handling of residential security deposits in Panama is strictly regulated by Ley No. 93 of October 4, 1973, as significantly modified by Ley No. 259 of 2021. These funds are overseen by the Ministry of Housing and Territorial Planning (MIVIOT), which acts as the mandatory custodian.

The Obligation to Deposit with MIVIOT
In Panama, landlords are legally prohibited from holding security deposits in private accounts. Article 13 and Ley 259/2021 mandate that the deposit must be consigned to the Dirección General de Arrendamientos at MIVIOT. These funds are held in specialized accounts at the Banco Nacional de Panamá or the Caja de Ahorros.
The legal procedure is as follows:
- The tenant pays the security deposit to the landlord at the start of the lease.
- The landlord must consign these funds to MIVIOT within five (5) business days of the contract's execution (Article 6).
- MIVIOT issues an official voucher (Certificado de Depósito).
- The landlord must provide a copy of this official receipt to the tenant.
Failing to consign these funds within the 5-day window renders any claims against the deposit legally unenforceable and subjects the landlord to administrative fines.
Returning the Deposit
Upon termination of the lease, the deposit (plus accrued interest) must be returned to the tenant, provided there are no outstanding debts or proven property damages.
The return process is an administrative procedure requiring formal authorization from MIVIOT to the state banks. While Ley No. 93 does not specify a statutory deadline for the return, MIVIOT’s official service standard for processing these refunds is thirty (30) business days.
Allowable Deductions
For a landlord to claim funds from the deposit held at MIVIOT, they must present evidence of:
- Rent Arrears: Unpaid rent installments up to the date of vacancy.
- Utility Debts: Outstanding balances for electricity, water, or other services stipulated in the contract.
- Property Damage: Costs for repairs of damages caused by the tenant’s negligence or misuse (Article 13). Normal wear and tear is excluded.
- Lack of Notice: Compensation if the tenant fails to provide at least thirty (30) calendar days' written notice prior to vacating (Article 10).
Disputes & Jurisdiction
If there is a disagreement regarding the return of the deposit or the validity of deductions, the Dirección General de Arrendamientos (MIVIOT) serves as the primary administrative authority for mediation and resolution through the Comisión de Vivienda. Their decisions can be appealed within the administrative hierarchy of the Ministry of Housing.
