Contract Duration and Penalties for Withdrawal in the Basque Country

Renting out your property in San Sebastian, Barakaldo, or anywhere in the Basque Country as a habitual residence subjects you strictly to the provisions of the national Ley de Arrendamientos Urbanos (LAU). Attempting to bypass these rights by including abusive clauses in the lease agreement will result in those clauses being declared null and void (they will be considered unwritten).
1. Mandatory Extension Periods (5 and 7 Years)
Under the LAU, tenants of habitual residences are guaranteed minimum contract durations to ensure housing stability.
- Even if the initial lease agreement is signed for a shorter period (e.g., 11 months or 2 years).
- The lease will automatically renew on an annual basis until it reaches a minimum of 5 years (or 7 years if the landlord is a legal entity/corporation).
- Once the mandatory 5 or 7-year period expires, if neither party provides proper notice of termination, the contract enters a tacit renewal period. This automatically extends the lease for up to 3 additional years. To prevent this tacit renewal, the landlord must provide notice at least four (4) months prior to the expiration date, while the tenant must provide at least two (2) months' notice.
2. Premature Exit: The Tenant's Right of Withdrawal
The LAU grants tenants the right to withdraw from a habitual residence lease early under specific conditions.

Minimum Stay Requirement: Tenants have the right to terminate the lease early, provided that at least six (6) months of the contract have elapsed.

They must notify the landlord of their intent to leave at least thirty (30) days in advance.

Withdrawal Penalty: If the tenant leaves early, the landlord may be entitled to compensation, provided this penalty was explicitly agreed upon in the lease contract. The maximum legally permitted penalty is one (1) month's rent for each remaining year of the contract (prorated for periods less than a year).
