Under the Ley de Arrendamientos Urbanos (LAU), which came into effect on 1 January 1995, and the specific regional regulations of Catalonia Law 13/1996, security deposits are strictly regulated to protect both landlords and tenants. In Catalonia, the management of these funds involves mandatory administrative registration with the regional government.

The Statutory Framework

Adhering to the established rules around security deposits protects landlords from costly administrative fines and ensures the legal validity of the lease agreement in the event of a dispute before the Juzgado de Primera Instancia.

Essential Requirements for Landlords

  1. Statutory Limits: While the LAU permits "additional guarantees" (Art. 36.5), for residential contracts of up to 5 years (or 7 if the landlord is a legal entity), any additional deposit or guarantee cannot exceed two months’ rent.
  2. Mandatory Administrative Deposit: Under Law 13/1996 and Decree 147/1997, it is compulsory to deposit the security deposit with INCASÒL. Failure to do so is a serious infraction that may result in surcharges of up to 20% plus interest and fines of up to €3,000 under the Catalan Housing Law (Law 18/2007).
  3. Return Timeline: The landlord must return the deposit within 30 days of the termination of the lease and delivery of keys. Beyond this period, the amount will accrue the legal interest rate (Art. 36.4 LAU).

Jurisdictional Enforcement

Disputes regarding the return or withholding of deposits are adjudicated by the Civil Courts (Juzgado de Primera Instancia) of the judicial district where the property is located. For administrative issues related to the mandatory deposit process, the Institut Català del Sòl (INCASÒL) is the governing body.
