In Murcia, security deposits (fianzas) are heavily regulated. Under Article 36 of the LAU, a landlord must require a security deposit equivalent to one month's rent for residential leases.

Collect Deposit
Collect the security deposit (up to 1 Month’s Rent (Residential); 2 Months (Commercial)) before the tenant takes possession.
Document Condition
Create a move-in condition report signed by both landlord and tenant.
Hold During Tenancy
Keep the deposit in a designated or legally required account.
Return or Claim
Return within one month after the return of the keys, with written justification for any deductions.
While the LAU mandates the collection of the deposit, the requirement to deposit the bond with regional authorities is established by regional administrative law, not the national LAU. Landlords must follow the specific regional regulations of the Directorate General of Housing of Murcia or retain the deposit if no regional requirement is actively enforced.
Additional Guarantees
In addition to the mandatory one-month fianza, landlords can ask for an "additional guarantee" (garantía adicional). Under the LAU, this is capped at a maximum of two months' rent.
Return Deadlines
The deposit must be returned within one month after the keys are handed back. If it takes longer, the tenant is entitled to claim the legal interest rate on the unreturned amount. Deductions can only be made for:
- Unpaid rent or utilities
- Damage beyond normal wear and tear
