Evicting a tenant in Navarre requires following the strict judicial procedures laid out in the Spanish Civil Procedure Act (LEC, effective 7 January 2000) and the Spanish Urban Leases Act (LAU, effective 1 January 1995). Self-help evictions are explicitly illegal and can result in criminal charges for coercion.

Non-Payment of Rent (Desahucio por Impago)

  1. Burofax: Send a formal notice demanding payment.
  2. Lawsuit: If not paid, file a lawsuit. The tenant has 10 days to respond.
  3. Enervación: The tenant may pay what is owed to cancel the eviction (allowed once per tenancy).
  1. Court Order: A judge issues the eviction order.

Because of the Ley 12/2023 housing law, additional protections exist for vulnerable tenants, meaning evictions in Navarre can often take 6 to 12 months.
