Cyprus: Mandatory Rental Disclosures
Landlords in Cyprus, governed primarily by the Rent Control Law (effective 28 January 1983) and the Contract Law (effective 11 February 1930), must provide specific documents and information to tenants at the start of a tenancy to ensure legal validity and compliance with tax and energy regulations.
Mandatory Lease Stamping
Every rental agreement in Cyprus must be formally stamped by the Tax Commissioner (Stamp Duty office). This is a legal requirement for the document to be admissible as evidence in any court proceeding (including the Rent Control Court).
- Deadline: Stamping should typically occur within 30 days of signing.
- Consequence: Unstamped leases may face penalties and cannot be used to support legal claims for possession or rent arrears.
Energy Performance Certificate (EPC)
Before a property is let, the landlord must provide a valid Energy Performance Certificate (EPC) to the prospective tenant. This certificate rates the building's energy efficiency from A to G and is mandatory for all new tenancies under the Energy Performance of Buildings Law.
Disclosure of Ownership and Service Address
The landlord is legally required to disclose:
- Their full legal name and contact address.
- A physical address in Cyprus where legal notices and court documents can be formally served.
Substantive Compliance Overview
Transparency in the disclosure phase is critical to avoiding later disputes regarding the property's legal status. For properties under the Rent Control Law, the landlord should also clarify the property's age and location, as this determines if the tenant becomes a "statutory tenant" once the initial contract period ends.
Beyond the initial disclosures, landlords should ensure that any significant changes to the property or the owner's contact details are communicated in writing. Proper documentation of the initial disclosure (e.g., a signed acknowledgment of receipt of the EPC) provides an essential layer of protection in case of future regulatory audits.
