For decades, the concept of a "rent increase" in Egypt was heavily dictated by whether a lease was signed under the legacy "Old Rent" laws or the liberalized "New Rent" system established by Law No. 4 of 1996, which came into effect on 31 January 1996.
While the market was previously stagnant for pre-1996 contracts, landmark legislation in 2025 has finally initiated a structured phase-out of the legacy rent control system.
1. The 2025 "Old Rent" Residential Reform (Law No. 164 of 2025)
Following the 2024 Supreme Constitutional Court ruling that declared the indefinite freezing of residential rents unconstitutional, the Egyptian Parliament enacted Law No. 164 of 2025. This law provides a bridge between legacy tenants and market rates.
The 7-Year Transitional Period
Starting in August 2025, all residential units remaining under the "Old Rent" regime entered a mandatory seven-year transition period.
- Automatic Termination: All such contracts will expire by operation of law in August 2032, after which landlords may reclaim the property or negotiate new market-rate leases.
- Immediate Multipliers: Upon the law's commencement, rents were immediately increased by a multiplier based on zonal classification (up to 20x the base legacy rent in high-value areas).
- Annual Escalation: Throughout the transition, rent increases by a fixed 15% annually (compounding).
Commercial vs. Residential
While Law No. 10 of 2022 handles legal entities and commercial tenancies (with its own 5-year phase-out), Law No. 164 of 2025 specifically targets the long-standing residential deadlock.
2. "New Rent" Increases (Post-1996 Contracts)
For leases signed under the Civil Code (Law No. 4 of 1996), rent increases are governed purely by the written agreement.
