1. Security Deposits

Deposits are typically 1-2 months' rent. Legally, the landlord MUST invest the deposit in an interest-bearing account and provide proof of interest to the tenant. Deposits must be returned within 7 to 21 days depending on the outcome of the joint ingoing and outgoing inspections.

2. Rent Increases (Fairness Standard)

South Africa has no national rent cap. Increases must be specified in an escalation clause within the lease. If a tenant deems an increase "unfair," they can approach the Rental Housing Tribunal (RHT), which uses the Consumer Price Index (CPI) as a primary benchmark for "fairness."

3. Eviction Procedures (PIE Act)

Self-help evictions (changing locks, cutting water/electricity) are criminal offenses. Eviction orders remain the exclusive domain of the courts.

  1. Breach Notice: Provide 20 business days to remedy (CPA requirement).
  2. Court Application: If the breach persists, apply for an eviction order under the PIE Act through the appropriate court.
  3. Sheriff Enforcement: Only the Court Sheriff can physically remove a tenant.

4. Maintenance and Habitability

Landlords are responsible for structural soundness, weatherproofing, and ensuring functional plumbing/electrical systems. Tenants are responsible for maintaining the property in the same state as received, excluding fair wear and tear.

5. Dispute Resolution: RHT

The Rental Housing Tribunal provides free mediation and arbitration for rental disputes (note that it does not have jurisdiction to grant eviction orders). Its rulings have the same weight as a Magistrate's Court order. As of 2026, many provinces allow for online case filing and digital hearings.
