The Eviction Process in Catalonia: Current Legal Framework

Landlords in Catalonia must navigate one of Spain's most protective tenant frameworks. Evictions are subject to both the national Spanish Housing Law (Law 12/2023) and Catalonia's own Law 24/2015 on Housing Emergency, which together impose significant pre-filing obligations on "Large Holders" (Grandes Tenedores).

1. Pre-Filing Requirements Under Law 12/2023 (National)

The Spanish Housing Law (Law 12/2023) introduced mandatory procedural requirements for Large Holders before an eviction lawsuit is admissible in court. These requirements remain in full force as of 2026:

  • Vulnerability Report: Large holders must provide a report from Social Services confirming the tenant's situation (or its absence) as a prerequisite for the court to admit the eviction lawsuit for non-payment.
  • Mediation Attempt: Large holders must demonstrate that an attempt at mediation or a viable housing alternative has been made before the court will admit the lawsuit.

2. Mandatory Social Rent (Catalan Law 24/2015)

Catalonia's own Law 24/2015 imposes additional, independent obligations on "Large Holders" that apply in parallel with national law:

  • The Social Rent Offer: Before filing an eviction for non-payment (impago) or foreclosure, a large holder must offer a "Social Rent" (alquiler social) proposal if the tenant is in a situation of "residential exclusion risk."
  • Scope: This obligation applies to evictions for non-payment and foreclosure. It does not apply to evictions for the expiration of the contract term (fin de contrato) based on established judicial interpretation.

3. Defining a "Large Holder" in Catalonia

The threshold for being considered a "Large Holder" (Gran Tenedor) is set by national Law 12/2023 and may be further adjusted by Catalan regional designation:

  • National Threshold (Law 12/2023): Owning 5 or more residential properties in a stressed zone, or 10 or more residential properties nationally.
  • Stressed Zones (Zonas Tensionadas): In municipalities designated as stressed zones by the Generalitat de Catalunya, landlords with 5 or more residential properties qualify as Large Holders and are subject to the full pre-filing requirements.
