You must present an 'Energieausweis' at the first viewing.
Rent Brake Disclosure (Mietpreisbremse)
Under § 556g BGB, if a rent brake is active, landlords must disclose the reason for exceeding the cap (e.g., prior rent, modernization) unsolicited and in writing before the tenant signs the lease.
Important: As of February 2026, the rent brake is active in the following municipalities in Mecklenburg-Vorpommern:
- Rostock (since October 2018)
- Greifswald (since October 2018)
In these areas, if you charge more than 10% above the local reference rent, you must disclose the statutory justification to the tenant beforehand.
Energy Performance Certificate Mandates
As mandated by the German Building Energy Act (Gebäudeenergiegesetz - GEG) § 80, landlords must unconditionally provide a valid Energy Performance Certificate (Energieausweis) to prospective tenants at the latest during the viewing and hand it over immediately after the conclusion of the lease agreement.
