Managing a residential rental property in the Balearic Islands (Mallorca, Menorca, Ibiza, and Formentera) means navigating one of the most tense and sought-after housing markets in all of Spain, where extremely high tourist demand directly collides with an extreme shortage of long-term residential supply.

The rules are strictly governed by the national Spanish Urban Leases Act (LAU), but feature ironclad regional regulatory control exercised by the IBAVI (Balearic Housing Institute).

The Mandatory Deposit at IBAVI

Any contract signed to reside in the archipelago triggers an immediate and inescapable regional obligation: the landlord does not keep the deposit. It is imperative to deposit the mandatory legal deposit equivalent to one month's rent with the IBAVI within a strictly enforced period of 30 business days.

Failing to do so not only exposes you to regional fines of up to €3,000, but it also ruins the tenant's right to deduct the rent on their Balearic income tax return (IRPF), setting you up for cross-lawsuits. Learn more about Security Deposits in the Balearics.

Rent Caps and Highly Stressed Areas

The Balearic Islands, due to their extreme tourist and residential overload, are a clear focal point for the imminent declaration of "Stressed Market Areas" under the umbrella of the new state Housing Law (12/2023).

  • Say goodbye to raising the rent based solely on the free year-over-year CPI (IPC).
  • The archipelago is submissively tied and paralyzed to the State Reference Index (INE), severely limiting speculation on the base rate. If you own 5 or more profitable properties in the Balearics, you are considered a penalized "Large Holder". Learn more about Rent Increases.

Minimum Contract Clauses (Long-Term vs. Seasonal)

The strong disruption of temporary workers (summer hospitality staff) creates confusion in the Balearics. But the LAU is unforgiving: if the house is the tenant's dwelling and vital refuge throughout the year, the contract grants guaranteed permanence:

  • Mandatory Blind Minimum Duration (5/7 Years): As an individual landlord, you must tolerate uninterrupted occupation for up to 5 years, and 7 if your rental is signed by a Balearic corporation or SL.
  • Note: Purely tourist (vacation) rentals fall under the Balearic Tourism Law and escape the LAU, but they require a demanding and scarce Tourist License (ETV). Attempting to camouflage a perpetual vacation rental by forcing "primary residence" contracts or systematically signing for 11 months carries punishment and cessation by the IBAVI for nullity. Evictions and Coastal Maintenance

  • Maintenance (Saltpeter and Dampness): The damaging marine climate obligates and forces the owner to blindly drag and pay all major bills and frequent structural rehabilitations caused by the deterioration of facades and rusted boilers. See Maintenance.
  • Defaults: Facing unpaid rent requires an urgent Burofax protocol; exhausting the rapid 30-day step to force a judicial launch in an island court with a lawyer and procurator. See Balearic Eviction Process.
