The Standard Residential Tenancy Agreement (Form 1)

In Manitoba, landlords are legally required to utilize the "Standard Residential Tenancy Agreement" (also known as Form 1), as prescribed by the Residential Tenancies Branch (RTB).

While you can technically draft your own form, it must contain all the prescribed information found in Form 1. Most property owners opt to use the exact provincial form to guarantee they are remaining strictly compliant.

Key Components of a Compliant Form 1 Lease

A proper tenancy agreement in Manitoba must detail:

  • Contact Info: The full landlord and tenant contact information.
  • Physical Address: The exact legal address and unit number of the rental property.
  • Term: The exact date the tenancy begins, and specifying whether it's a fixed-term (e.g., a one-year lease) or periodic (a month-to-month agreement).
  • Rent: Total rent due, the payment schedule, and what exactly that rent includes (e.g., parking, utilities).
  • Deposits: Details surrounding the exact amount of the security and/or pet damage deposit (Cannot exceed 50% of a month's rent for a security deposit, and up to 100% of a month's rent for a pet deposit).
  • Occupants & Purpose: Explicitly stating that the unit is strictly for residential purposes and establishing the list of occupants.

Understanding Complex Rules

Landlords may append custom "house rules" to the tenancy agreement, providing these rules are reasonable, promote safety and welfare, and apply to all tenants fairly.

Common rules involve noise protocols, amenity reservations, and pet restrictions. If these rules are appended to the lease, the tenant must agree to them mutually to be bound by them, unless they are standard, pre-existing building rules disclosed before signing.

The 21-Day Delivery Requirement

Signing the lease is only half the process; delivery is the other half. It is a strict requirement under the Residential Tenancies Act that a landlord must provide the tenant with a fully executed copy of the signed tenancy agreement within 21 days of it being signed.

If you fail to provide the copy within 21 days, the tenant may have legal grounds to withhold rent until the document is supplied.
