Transparency Regarding Building and Local Conditions

At the initial moment of presenting the property, the landlord or owner must fully disclose any existing "defects" or prohibitions if the commercial space has limitations that would affect its natural corporate purpose. They must disclose:

  • Existing Administrative Resolutions or Orders by state, municipal, or health security entities (such as a lack of access to comply with the National Law #7600 regarding disabilities).
  • Regulations on weight, impact, or emissions from the corresponding zoning regulatory plan for the street or establishment.
  • Obligatory disclosure of existing regulations limiting commercial sectors within shopping centers or office parks to avoid business conflict (for example, a pre-granted exclusivity to establish a single coffee shop).
