After Formal Notice

Attempting to apply automatic or fixed surcharges (e.g., a fixed 100€ penalty for paying after the 5th of the month) on residential rents in Ibiza, Mallorca, or Menorca conflicts with Spanish jurisprudence. Such clauses can be declared abusive and nullified by a judge under the Ley de Arrendamientos Urbanos (LAU).

The Legal Framework for Rent Payments

Article 17 of the LAU dictates that rent shall be paid in the time and manner agreed upon by the parties. In the absence of a specific agreement, rent must be paid within the first seven (7) days of each month.

It is important to note that the LAU does not mandate rent to be paid "in advance" as a universal rule, nor does it establish a legal "tolerance" period for rent delays. If the contract stipulates payment by the 5th, payment on the 6th is technically a breach, although landlords are encouraged to act reasonably.

Punishing the Arrears: Agreed Interests

Any civil magistrate may declare a late fee clause as "abusive" and proceed to nullify it if the penalty is disproportionate (e.g., demanding 25 euros per day of delay) or imposes excessive monthly percentages.

The Clause that Prevails Judicially

To protect yourself against frequent delays while remaining compliant, you can include a clause drafted similarly to this: "Once the agreed payment period has ended, the outstanding amount will accrue a default interest in favor of the landlord equivalent to the Legal Interest of Money, increased by two or three percentage points, calculated on the amounts owed until their complete payment."

Eviction for Reiterated Arrears

Faced with chronic late payers, internal contractual fines offer little practical protection. The most effective legal recourse is to proceed toward eviction for non-payment:

  • Send a Burofax requiring the immediate payment of the debt.
  • If the tenant fails to clear the debt within 30 days of receiving the burofax, they lose the right to halt the eviction process by paying at the court (enervación), allowing the landlord to recover the property more swiftly.
