In the Balearic context, typical landlord responsibilities include:

  • Structural Dampness and Saltpeter: Coastal erosion frequently impacts roofs, facades, and foundations. Repairs to terraces (community or private), leakage remediation, and the treatment of fungus or salt-damaged walls are the landlord's responsibility.
  • Major Systems and Machinery: The replacement or major repair of Air Conditioning units, heat pumps, and water heaters—provided the failure is due to age or normal operation—falls on the owner.
  • Plumbing and Electrical Infrastructure: Maintenance and repair of the property's core networks.

The landlord is exempt from these costs if the deterioration is attributable to the tenant. However, under Article 1563 of the Civil Code, the tenant is legally presumed responsible for any deterioration or loss of the leased property unless they can prove that the damage occurred without their fault.

Tenant Maintenance and Minor Repairs

According to Article 21.4 of the LAU, "small repairs required by the wear and tear of ordinary use of the dwelling shall be the responsibility of the tenant." Spanish jurisprudence and local practice generally define these as:

  • Basic Upkeep: Unblocking pipes caused by daily usage, replacing light bulbs, and standard cleaning.
  • Fixtures and Fittings: Replacing tap washers, shower hoses, and repairing blinds damaged by daily operation.
  • Filter Maintenance: Regular cleaning or replacement of HVAC filters to ensure system efficiency.

Mitigating Insular Maintenance Disputes

Disputes often arise in Ibiza and Mallorca regarding whether a malfunctioning appliance requires a "minor repair" (tenant cost) or "replacement due to end-of-life" (landlord cost). These disagreements can lead to costly litigation in the Juzgado de Primera Instancia.
