In the Kingdom of Bahrain, the phase of writing and documenting the lease contract is the cornerstone upon which the investment system is built and through which the rights of both parties are preserved. The new Lease Law issued in 2014 stressed the necessity of the market's transition from randomness to transparent organization by imposing a mandatory contract registration system.

Paramount Importance: Mandatory Lease Contract Registration (Article 6)

The most crucial substantive point for any landlord or real estate investor in Bahrain is strict adherence to what is stated in Article 6 of the Lease Law:

  • Mandatory Registration: The lessor of the property must register all lease contracts (or amendments made to them) with the competent authority (which is the Lease Contracts Registration Office in the Municipalities Affairs) within (one month) from the date of signing the contract. As long as it is not registered, the contract is not considered effective against third parties.
  • Penalty for the Refuser (Non-Admission of Lawsuit): The law drew a dramatic punishment for the landlord who fails to document: The landlord is completely prevented from filing any lawsuit before the (Rent Dispute Resolution Committee), whether to demand eviction or payment of rent arrears, until they correct the mistake and pay the registration fees and the late fine owed to the Ministry of Municipalities.
  • The tenant has the right to take the initiative and document the contract themselves if the landlord delays doing so to preserve their official rights, such as issuing a CPR.

Conditions for Drafting and Essential Contract Clauses

To ensure the contract is accepted and ratified in Bahrain, it must be drafted in writing with the ink of truth and in clear legal terms covering:

  1. Documented Identification: The Personal Number (for the Bahraini) for both parties, and passport and personal residency (CPR) data for the resident and expat tenant.
  2. Accurate Unit Description: Specifying the property address, Governorate, residential complex, building number, and apartment assigned by the Survey Authority to avoid nullification of legal notifications.
  3. Maintenance Obligations Clearly: Specifying who bears the burdens of periodic maintenance and urgent maintenance in a formulation that accepts no interpretation.
  4. Determining Responsibility for Utility Bills: Explicit reference as to whether the rental value is "inclusive" of Electricity and Water Authority fees or "exclusive".

Arbitrary Clauses and Wrong Customs

Any arbitrary clauses invented by landlords in their drafts have no validity before the judiciary, such as:

  • A clause (arbitrarily withdrawing the property without justification). Once the contract is concluded, the contract extends by law to its end.
  • A clause (exaggerated monthly increase). All increase requests are subject to the control of the maximum limit law (two years - and a 5% rate).
